What is paternity fraud?

WHAT IS PATERNITY FRAUD: Paternity fraud is cuckolding (cuck-old, noun). According to Webster's Dictionary, "Cuckold" is an allusion to the cuckoo bird on which the word cuckold is based. The female of some Old World cuckoos lays its eggs in the nests of other birds, leaving them to be cared for by the resident nesters. This parasitic tendency has given the female bird a figurative reputation for unfaithfulness as well. Hence, in Old French, we find the word cucuault, composed of cocu, cuckoo, cuckold, and the pejorative suffix -ald and used to designate a husband whose wife has wandered afield like the female cuckoo. An earlier assumed form of the Old French word was borrowed into Middle English by way of Anglo-Norman. Middle English cokewold, the ancestor of Modern English cuckold, is first recorded in a work written around 1250.

So, paternity fraud is a parasitic tendency of unfaithful women to cuckold; that is, a tendency of unfaithful women to surreptitiously claim a man is the father of her children even though he is not.

The children's rights movement calls it "Child Identity Theft." The father's rights movement calls it "paternity fraud". It is the same thing by a different name. There can be dozens or more victims from just one incident: the child(ren), the biological father, the falsely named father, their families of choice, and the extended families of all involved.

Withholding someone's true biological identity can dramatically affect lives. Potential adverse consequences are endless, including death. Paternity fraud and Child Identity Theft can easily adversely impact "Duped Dads," involved children, including the adopted; sperm donors, and those needing blood transfusions from a parent, just to name a few of the potential victims, and how about rights and benefits?

Victims of paternity fraud and Child Identity Theft may be denied otherwise entitled to inheritance rights, social security benefits, military benefits, and other rights and benefits associated with biological parentage.

What is paternity testing?

Can wrongful paternity be life threatening?

The consequences to anyone not knowing their biological relationships can be life threatening. For example, children are frequently injured and sometimes need blood from a parent. There have been cases where a dad rushed to a hospital to give blood only to find out it did not a match his child’s blood. Moreover, the "Duped Dad" found out there and then that he was not the biological father. Imagine how helpless you would be watching a child you love struggle for life while you begin sorting through the realization, confusion, and shock that you are not the biological father? Are the tests painful?

No, the tests are not painful. Instead of drawing blood, noninvasive painless mouth swabs are typically used (buccal swab).

Can PaternityFraudDNA work with blood samples?

Most biological samples are acceptable, including a tube of blood or drops of blood on a blood spot card (additional charges apply to blood samples that are more than 30 days old).

What types of tests are there?

There are numerous types of tests for a wide range of uses as noted in the first paragraph. With respect to paternity fraud, the two most common are legally binding tests and curiosity tests which are conducted by you in the privacy of your own home. PaternityFraudDNA only offers legal tests though.

Which type of test is best?

That depends upon your needs, but with respect to paternity fraud, the legally binding tests are the strongly recommended. Legally binding tests are a bit more expensive than home tests, but home tests are not admissible in court, since there is no established chain of evidence or validation by a neutral third party. If a court orders you to take another test, you will pay twice, once for the home test and again for the legally binding test. If you first take the legally binding test, and are again court ordered to take another legally binding test, you may not have to pay twice. You may successfully argue that you already paid for a legally binding test from a fully accredited laboratory and reliable company thereby establishing a clear chain of evidence, including the use of a trained neutral third party as a collector. You can ask that the offending party pick up the costs instead of you, which does not mean the court will grant your request, but it does mean that you have a plausible argument to avoid paying twice.

Is advocacy a conflict of interest?

No, absolutely not. PaternityFraudDNA has to be absolutely objective to maintain credibility. Even if we serve as an advocate for clients and related causes, PaternityFraudDNA has no interest in whether test results are negative or positive. They are what they are, a client's situation cannot be effectively resolved until the truth is known, one-way or the other.

Is the lab accredited?

Absolutely, the laboratory is accredited by the American Association of Blood Banks (AABB). The AABB developed strict standards for performing paternity testing which most be complied with to maintain accreditation. The AABB performs extensive on site laboratory inspections to ensure proper methods, techniques, and equipment are used. Accreditation means that laboratories adhere to the strict standards and guidelines established by the AABB. The laboratory also participates in the Parentage Testing Survey, which is co-sponsored by the AABB and the College of American Pathologists, as an external proficiency-testing program.

Who needs to be tested for determining paternity?

The father, child, and mother or other blood relation to the person in question need to be tested, as appropriate and available. We can accurately test without the mother's sample, but test processing the sample(s) and getting the results may take longer than for similar tests.

How accurate are PaternityFraudDNA tests?

PaternityFraudDNA tests are extremely accurate. If the DNA of the alleged father and child matches, the probability that he is the biological father is typically over 99.98%. On the other hand, if mismatches result between the DNA an alleged father and child, they are 100% excluded from being biologically related, they are not biological father and child. However, there are circumstances, though rare, that do not allow for certainty, even though the determination through testing the DNA is as accurate as possible.
